Welcome to Perfect Job. Please read these Terms of Use (“Terms”) carefully before accessing or using the website, applications, software, assessment tools, and recruiting services provided by Perfect Job Inc. (“Perfect Job,” “we,” “us,” or “our”).

By accessing, registering for, or using our Services, you (“User,” “Candidate,” “Applicant,” or “Employee”) agree to be bound by these Terms and our integrated [Privacy Policy]. If you do not agree to all of these Terms, you are strictly prohibited from using our Services.


1. Eligibility and Account Security

To use our Services, you must be at least 16 years of age (or the minimum legal age required in your jurisdiction to seek employment) and possess the legal authority to enter into a binding contract.

If you create an account, you agree to:

  • Provide accurate, current, and complete registration information.
  • Maintain the confidentiality of your account password and log-in credentials.
  • Accept sole responsibility for all activities that occur under your account.
  • Notify us immediately at security@perfectjob.com if you suspect any unauthorized access to your account.

2. Intellectual Property Rights

The Services and all underlying content, features, and functionality—including but not limited to software, code, algorithms, artificial intelligence models, user interfaces, design assets, text, graphics, logos, and assessment questions—are owned exclusively by Perfect Job or its licensors.

These assets are protected by United States and international copyright, trademark, patent, and trade secret laws. You are granted a limited, non-exclusive, non-transferable, and revocable license to access the platform solely for your personal, non-commercial employment application and assessment purposes.


3. User Content and License Grant for AI Training

You retain ownership of the original text within your resume, CV, and basic profile identifiers. However, by submitting content, completing assessments, communicating through the platform, or participating in interviews, you grant Perfect Job a specific operational and commercial license.

Crucial License Grant Disclosure

You grant Perfect Job a worldwide, perpetual, royalty-free, irrevocable, fully sublicensable, and transferable license to use, host, store, reproduce, modify, adapt, publish, and distribute your "User Content"—including resume text, screening question answers, communication history (emails, texts, call logs), and audio/video assessment recordings. This license explicitly permits Perfect Job to sell, lease, or license your data to third-party commercial entities, technology companies, and research institutions for the purpose of training, testing, and refining artificial intelligence (AI), machine learning (ML), and large language models (LLMs). Your rights to opt out of, restrict, or delete your data from future AI training datasets are governed strictly by the provisions outlined in our [Privacy Policy] in compliance with the CCPA and GDPR.


4. Consent to Assessment Monitoring and Session Recording

Perfect Job utilizes advanced fraud prevention and data analysis tools to ensure the integrity of the recruitment process. By using our assessment and video interview tools, you acknowledge and agree that:

  • We may capture full audio and video recordings of your interview and assessment sessions.
  • We may utilize web session recording tools to log your digital interactions on our site, including mouse movements, clicks, scrolling patterns, and keystrokes.
  • Refusal to permit audio, video, or session recording may result in your immediate disqualification from the application process by the hiring manager, as these verification tools are core dependencies of our Services.

5. Automated Decision-Making and AI Screening Disclaimer

You acknowledge that Perfect Job and its corporate clients may utilize Automated Decision-Making Technology (ADMT), algorithms, and artificial intelligence to parse resumes, rank applicant qualifications, and analyze video or audio assessment inputs.

  • Perfect Job provides these algorithmic recommendations as an administrative tool for employers.
  • Ultimate hiring decisions are made independently by the respective employers and hiring managers. Perfect Job bears no liability for any hiring, rejection, or employment decisions made by third-party clients using our platform.

6. TCPA Consent and Electronic Communications

By providing your mobile phone number and email address to Perfect Job, you provide your express written consent to receive recurring automated electronic communications from us or on behalf of our hiring clients.

  • Communications Include: Text messages (SMS), multimedia messages (MMS), phone calls, pre-recorded voice messages, and emails regarding job alerts, application updates, interview confirmations, and onboarding steps.
  • Opt-Out: You may opt out of SMS communications at any time by replying "STOP" to any text message received. You acknowledge that opting out of text notifications may delay critical updates regarding your job application.
  • Carrier Charges: Standard message and data rates applied by your mobile carrier are your sole responsibility.

7. Prohibited Conduct

When utilizing the Perfect Job platform, you agree strictly not to:

  • Provide fraudulent, inaccurate, or misleading resume data, identity credentials, or assessment answers.
  • Engage in cheating, plagiarism, or use external unapproved generative AI tools during assessments.
  • Use any robot, spider, scraper, or other automated script to access, extract, or index platform data.
  • Attempt to reverse-engineer, decompile, or copy the underlying code, scoring metrics, or AI models of Perfect Job.
  • Upload any files containing viruses, Trojan horses, worms, or malicious scripts designed to disrupt platform security.

8. Disclaimer of Warranties

YOUR USE OF THE SERVICES IS AT YOUR SOLE RISK. THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.

Perfect Job expressly disclaims all warranties of any kind, whether express, implied, or statutory, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not guarantee that:

  • The platform will function uninterrupted, secure, or free of errors or malware.
  • The use of our platform will result in a job offer, employment interview, or any specific career outcome.
  • The automated AI screening metrics will flawlessly analyze your qualifications.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PERFECT JOB, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

This includes, without limitation, loss of profits, loss of data, loss of employment opportunities, or damages resulting from:

  1. Your use of or inability to use the platform.
  2. Any employment decisions (hiring or rejection) made by third-party employers.
  3. The automated analysis or monetization of your data for AI training models.
  4. Unauthorized access to or alteration of your transmissions or data.

In no event shall Perfect Job’s total aggregate liability for all claims arising out of these Terms exceed one hundred U.S. dollars ($100.00).


10. Indemnification

You agree to defend, indemnify, and hold harmless Perfect Job, its affiliates, corporate clients, licensors, officers, and employees from and against any claims, liabilities, damages, judgments, awards, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms, your misuse of the platform, or any fraudulent information you submit.


11. Governing Law and Dispute Resolution

These Terms and any dispute arising out of your use of the platform shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles.

  • Binding Arbitration: You agree that any legal dispute, claim, or controversy arising out of these Terms or the breach thereof shall be settled by binding, individual arbitration administered by the American Arbitration Association (AAA) in San Francisco, California.
  • Class Action Waiver: YOU AND PERFECT JOB AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

12. Changes to these Terms

We reserve the right to modify these Terms at any time. When we make material updates, we will revise the "Last Updated" date at the top of this document and notify you via a system dashboard banner or email. Your continued use of the platform following the posting of revised Terms constitutes your explicit acceptance of the updated terms.
